Agreement to Purchase
By placing an order with Little Creek, you agree to these terms and conditions, together with any product-specific information, shipping instructions, and return/guarantee policies. If you do not agree, please do not proceed with purchase.
Product Nature
Our products are live plant cuttings and therefore living material. Cuttings are carefully propagated and nurtured; we ensure that all cuttings leave our care in excellent condition with the expectation of proper care following receipt.
Product images and descriptions are provided for guidance only; colours, size, and form may vary due to growing conditions, climate, and time of season. We strive to ensure all product information is accurate and up to date.
Ordering & Payment
Orders must be placed via our online checkout. Accurate shipping information is the Buyer’s responsibility.
Payment must be completed at time of order. Orders cannot be changed or cancelled except in exceptional circumstances (and may be subject to a restocking fee of up to 20%).
Once an order is placed, availability, pricing and product offerings may change; we may cancel orders if product becomes unavailable—refunds will be issued in such cases.
Shipping, Risk & Responsibility or Local Pick-up
Shipping fees are the Buyer’s responsibility, and must be paid prior to dispatch.
The Buyer accepts the risk of lost, damaged or delayed shipments once the package leaves the Seller’s hands. The Buyer may file a claim with the carrier, but the Seller is not liable for carrier mishaps.
For cuttings: Inspect immediately upon receipt. Photograph condition. If the cutting arrives damaged or appears unviable on the day of delivery, you may request a replacement—provided care instructions were followed. Video proof may be required.
We begin shipping when weather conditions are suitable (e.g., no freezing forecast). Shipping dates may shift due to climate or logistic issues. Most Cuttings will be shipped late April if the weather permits
We offer both shipping and local pick-up options. Shipping costs vary based on your location.
Local pick-up is available at our designated location during business hours. You will receive notification when your order is ready for pick-up.
Returns and Replacements
Most sales are final. Some items may carry a limited guarantee (e.g., viable cuttings or true-to-type tubers). Any guarantee must be explicitly stated.
If a product is guaranteed and fails under stated terms, we may offer a replacement before a refund. The Buyer must follow instructions exactly, including returning any requested item at Buyer’s cost if required.
Refunds may only be issued for valid issues under the stated guarantee, and may exclude restocking or transaction fees.
Mistakes happen. That being said we are meticulous when it comes to making sure our customers receive the cuttings they pay for. However If a cutting was mislabelled, please let us know immediately and we will endeavour to replace it.
Combining Orders
We are a small business and will do our best to combine orders. All shipping expenses are based on single packages so that if a customer chooses to add other products after their initial order shipping costs will be reflected realistically.
Orders placed with separate addresses or names cannot generally be combined.
Harassment and Cyberbullying Policy
Little Creek values respect, fairness, and a supportive online environment for everyone. We welcome honest feedback and open communication but do not tolerate harassment, intimidation, or defamatory conduct of any kind directed toward our business, staff, or community.
1. Definition of Harassment
Harassment includes but is not limited to:
- Repeated or unwanted contact through email, social media, or other online platforms
- Threatening, abusive, or defamatory language or behavior
- Posting false, misleading, or harmful statements about our business, products, or people
- Coordinated online attacks, fake reviews, or efforts to damage our reputation
Such actions may constitute criminal harassment under Section 264 of the Criminal Code of Canada, or defamation (libel) under Canadian civil law.
2. Our Rights
We reserve the right to:
- Report incidents of online harassment, defamation, or cyberbullying to local authorities or the RCMP National Cybercrime Coordination Unit
- Pursue legal action for defamation, libel, or harassment under applicable Canadian laws
- Request removal of harmful or false content from online platforms, including Google, Meta (Facebook/Instagram), Shopify, or others
- Ban individuals from interacting with our website, social media, or online store if they engage in prohibited conduct
3. Possible Outcomes for Perpetrators
Depending on the severity of the behavior, consequences may include:
- Immediate reporting to the relevant online platform for policy violations
- Formal notice from our legal representative (cease-and-desist)
- Civil legal proceedings for damages
- Criminal investigation or charges in cases of threats, stalking, or repeated harassment
4. Our Commitment

- Responding to all genuine customer inquiries and concerns in a timely, professional manner
- Maintaining a safe online space for our customers and team
- Documenting and reporting any unlawful or harmful activity as required by law
5. Policy Agreement by Purchase
By purchasing any products, plants, or cuttings from [Your Business Name], you acknowledge that you have read, understood, and agreed to all store policies, including but not limited to our Refund, Replacement, Shipping, and Harassment & Cyberbullying Policies.
All transactions imply acceptance of these terms. Customers who disagree with or choose not to comply with our policies should refrain from completing a purchase.
